Judge to decide if Teichmann provoked or not

A JUDGE will decide today if Jamie Rex Teichmann was provoked or intended to kill or maim Michael Manson in a 2010 roadside fight.

A jury found Teichmann not guilty on Thursday of murder after a seven-day trial in the Brisbane Supreme Court, but guilty of the manslaughter of Mr Morgan outside Coominya.

The court heard that on December 10, 2010, Teichmann was having drinks for a friend's birthday at the Bellevue Hotel, where he flirted with local woman Katrina Bush.

After Ms Bush left the pub, Teichmann decided to go to her place but found Michael Manson already there.

The two men got into a brief fight before Teichmann drove away, but Mr Manson followed him and angrily made him pull over on the side of a country road, where the fight continued.

The court heard that during the fight Mr Manson told Teichmann he was a "pussy" and he had thought Teichmann would "hit harder than that".

After that Teichmann "laid into" Mr Manson, punching, kicking and stomping his head.

Mr Manson collapsed, unconscious on the ground.

Teichmann called the friends he had been drinking with and drove to get them before he returned to Mr Manson's body. The three put Mr Manson in a ute tray, which they drove to another location, not visible from the road, and left it.

Justice John Bond is expected to make a finding on whether Teichmann did not intend to kill or maim Mr Manson, or if he was provoked into the killing.

Crown prosecutor Ben Power said Teichmann's repeated attacks on Mr Manson's head showed intent to at least seriously hurt him, and this meant the jury must have believed Teichmann was provoked into killing Mr Manson.

However, Teichmann's lawyer said evidence during the trial suggested his client had not intended to seriously hurt Mr Manson and therefore must have been provoked.
