Former doctor jailed again for child porn offences

A BULGARIAN jail sentence was not enough to turn a former Nambour and Gatton doctor off child porn.

In 2009 Joseph Lee Smith was jailed in Bulgaria for making child porn.

On Tuesday he was sentenced for looking up and sharing child porn in a Brisbane internet cafe just weeks after he was released on parole for a Queensland child porn sentence.

Smith, 42, pleaded guilty in Brisbane Supreme Court to possessing child porn, using the internet to access child porn, and making child porn available to others on the internet.

The court heard Smith hired a private room in a Fortitude Valley internet cafe next door to a police station for six hours on Sunday, April 27, 2014.

He had been released on parole less than a month before.

He plugged a USB drive into the computer and logged onto a peer-to-peer file sharing network.

He began downloading child pornography and making his own collection available to others. The court heard it is not known whether anyone accessed his images.

Cafe staff who were monitoring his usage contacted police who quickly arrived and arrested him.

The court hears Smith made "full and frank admissions" to the offences and told police he had done the same thing weeks before.

Smith was formerly a doctor who worked briefly for Queensland Health at the Nambour and Gatton Hospitals and Mater Children's Hospital in Brisbane.

He was jailed in Bulgaria after he pleaded guilty to making child porn while on a holiday from his job at the Mater.

Defence lawyer Lars Falcongreen said Smith had already spent a year in prison because of a "stupid mistake".

Judge Michael Noud said after reading a letter of apology from Smith he believed Smith had an insight into his offending and had strong prospects of rehabilitating.

"I think if you keep a rein on him for a couple of years - two or three, the maximum - that would serve him and the community," he said.

Smith was sentenced to two years jail, to be released after 10 months, and three years probation.
