Child killers to have babies taken away under new laws

PARENTS convicted of killing a child will have their future children removed from their care at birth under new laws before NSW Parliament.

Labor MP Tania Mihailuk introduced the bill as a reaction to the 2012 death of Chloe Valentine in South Australia.

The four-year-old died after being forced to ride a motorbike that she repeatedly crashed while her mother and partner documented the abuse on film.

Chloe was the subject of 20 child protection notifications before her death.

Ms Mihailuk said the proposed law would also prohibit anyone guilty of the murder or manslaughter of a child from living at the same place as a young person, or coming within a specified distance.

She mentioned Lake Macquarie man Benjamin Leach, who was convicted in 2008 of the manslaughter of his seven-week-old daughter, Ikicia. 

Leach was released from prison after less than four years.

He changed his name, settled with a new partner without disclosing his crime and the couple had a child together.

He was only discovered when Ikicia's mother stumbled across evidence of his new life on Facebook.

"Under existing NSW legislation, there is no specific provision that states that a child born to or in the care of a person, such as Leach, with a previous conviction for a serious violent offence against their own child should be prohibited from caring or residing with their own or other children in the future," Ms Mihailuk said.
