Mayor, weatherman invoked in bizarre cup of water case

A MAN charged after allegedly throwing a cup of water at a woman has attempted to use Channel 7's weatherman and the Fraser Coast Mayor to escape penalty.

The Hervey Bay Magistrates Court was in session on Tuesday to hear the "David and Goliath" case of Graham Taylor.

The Burrum Heads man appeared before Magistrate Stephen Guttridge charged with committing a public nuisance offence.

He promoted his innocence after several appearances in court and on Tuesday he was found not guilty.

It was alleged that on December 7 last year Mr Taylor threw water at a woman at the Burrum Heads Community Centre.

Speaking outside the court,  Mr Taylor told the Chronicle there was no proof the water that landed on the woman had come from his plastic cup.

The 60-year-old attempted to enlist the services of Sunshine Coast Channel Seven weatherman Livio Regano to explain to the court how drops of water could fall from the sky.

"Queensland weather, it can spit at any time," Mr Taylor said.

"Livio explained that droplets of water can happen at anytime."

But Police prosecutor Senior Constable Jeanette Grigoris objected and the report was not admitted.

After the verdict, Mr Taylor was relieved and described his court battle as inspirational.

Fraser Coast Mayor Gerard O'Connell was also summoned as a witness by Taylor, but did not show.

None of the witnesses in the matter gave evidence Mr Taylor's action of throwing the water was intentional and he was found not guilty.

Mr Taylor will return to court on September 5 to face six counts of failing to wear a bicycle helmet.
